WHEREAS, Section 83.01 of the Wisconsin Statutes establishes a two year term for the County Highway Commissioner, ending on the first Monday in January of the second year after appointment and confirmation by the County Board, and 

            WHEREAS, the County Board may establish a different term for the County Highway Commissioner, and  

            WHEREAS, Ordinance No. 99-21 established an indefinite term for the Highway Commissioner, and

            WHEREAS, the Highway Committee recommends re-establishment of the two-year term, commencing upon confirmation of the Highway Commissioner by the County Board, subject to the provisions of Section 59.18(2)(b), Statutes,  

            NOW, THEREFORE, THE JEFFERSON COUNTY BOARD DOES HEREBY ORDAIN:  

(2) Ordinance No. 99-21 is hereby repealed;  

(3) Pursuant to Section 59.18(2)(b), Statutes, the person employed as Highway
     Commissioner is employed at will, serving at the pleasure of the County
     Administrator; Prior to the end of the term, the County Administrator may
     reappoint the Highway Commissioner for another term, which reappointment
     requires confirmation by the County Board; During the term, the Highway
     Commissioner may be removed at the pleasure of the County Administrator;  

(4) As employment in the position of the Highway Commissioner is at will, the
     probationary period described in the Personnel Ordinance shall not apply.
     Benefits shall accrue and be administered pursuant to the Personnel
     Ordinance as if there were a six month probationary period;  

(5) In the event of conflict between this ordinance and any other ordinance or
      resolution, this ordinance shall control.  

            This ordinance shall be effective after passage and publication.

Fiscal Note:  This is a budgeted position.  Expenditures to support the position are not anticipated to exceed the budgeted amount.
